The opinion of the court was delivered by On November 10, 1954, and during the third day of petitioner's trial by a jury on a charge of murder in the first degree, he advised the court in the presence of his court-appointed counsel that he wished to change his plea from one of not guilty, to a plea of guilty to murder in the second degree, and was sentenced to confinement in the Kansas State Penitentiary for a period of 40 years. The following proceedings occurred in the district court when the petitioner changed his plea: ""THE COURT: You are charged with second degree murder, how do you plead, guilty or not guilty? ""MR. REDD: Guilty. ""THE COURT: You are pleading guilty because you are guilty? ""MR. REDD: I guess so. ""THE COURT: It is not `guess work.' You either do or you don't? ""MR. PYLES: We have to make a record. ""MR. REDD: Yes; guilty. ""THE COURT: You are pleading guilty because you are guilty? ""MR. REDD: Yes, sir.""
